This Privacy Policy (“Policy”) governs the access to and use of the XTuck Technology Portal (“XTuck Portal” or “Portal”), a proprietary technology platform developed and maintained by CybHop Tech LLP, a Limited Liability Partnership incorporated under the Companies Act, 2013, having its principal office at Chandigarh, Union Territory, India. By accessing, browsing, or using the XTuck Portal, the User acknowledges that they have read, understood, and agreed to be bound by the terms set forth in this Policy. If the User does not agree to these terms, they are advised to immediately cease all use of the Portal.

Authorized Use

The XTuck Portal is made available for specific and authorized activities related to, including but not limited to:

  • Data validation and verification
  • Data consistency and quality checks
  • Compliance-driven review processes

Ownership and Intellectual Property

All intellectual property rights, including but not limited to copyrights, trademarks, trade secrets, algorithms, source code, and database structures relating to the XTuck Portal, are solely owned by CybHop Tech LLP.

Use of the Portal does not grant any license or right to the User over the Portal, its components, or its contents.

Use of Uploaded Data and Datasets

By uploading, submitting, or processing data through the XTuck Portal, the User hereby grants CybHop Tech LLP a limited, non-exclusive, royalty-free, worldwide, irrevocable license to use such data for:

  • Internal system performance review
  • Statistical, analytical, or operational performance evaluations;
  • Enhancing the accuracy and efficiency of proprietary technology
  • AI training, testing, and benchmarking

CybHop Tech LLP shall not disclose or sell user-uploaded data to any third-party unless explicitly permitted or required under applicable law.

Data Security and Confidentiality

CybHop Tech LLP exercises commercially reasonable industry standards, including but not limited to encryption, access controls, firewall protection, and audit logs, to ensure that the data remains secure, confidential, and protected from unauthorized access, disclosure, or modification.

However, despite best efforts, no digital platform is entirely immune to unforeseen events, cyberattacks, or force majeure events

Notification in the Event of a Breach

In the event of a suspected or actual data breach beyond the reasonable control of CybHop Tech LLP:

  • The User must notify CybHop Tech LLP within 72 (seventy-two) hours of becoming aware of such breach
  • The notification must be made via email to [email protected]
  • The communication must be signed with a Class 3 Certified Digital Signature as per Indian IT Act standards

Failure to comply with this obligation may result in waiver of any liability or responsibility on the part of CybHop Tech LLP.

Limitation of Liability

To the maximum extent permitted under applicable law, CybHop Tech LLP shall not be liable for:

  • Any direct, indirect, incidental, consequential, or punitive damages arising from use or inability to use the Portal
  • Loss of data, profits, or business opportunities
  • Breaches resulting from third-party intrusions, technical failures, acts of God, or misuse by Users

Governing Law and Dispute Resolution

This Policy and any usage of the XTuck Portal shall be governed by and construed in accordance with the laws of India.

Jurisdiction

All disputes arising out of or in connection with the Portal shall lie exclusively within the jurisdiction of courts situated in the Union Territory of Chandigarh, India.

Arbitration Clause

  • The User irrevocably agrees that a permanent sole arbitrator, appointed by CybHop Tech LLP and based in Chandigarh, shall resolve all disputes, differences, or claims.
  • Arbitration shall be conducted in accordance with the Arbitration and Conciliation Act, 1996, as amended.
  • The decision of the arbitrator shall be final, conclusive, and binding on all parties.
  • No party shall seek recourse to any court or judicial body without first exhausting the arbitration process.
  • Arbitration is deemed a mandatory precondition for any further legal action or remedy.

Termination and Revocation

CybHop Tech LLP reserves the right to terminate access, revoke licenses, or suspend use of the Portal at any time, with or without notice, for violations of this Policy, misuse, or any activity deemed illegal or harmful to the Portal’s operations or reputation

Indemnification

The User agrees to indemnify and hold harmless CybHop Tech LLP, its partners, officers, employees, and agents from and against any claims, liabilities, damages, losses, or expenses arising out of or in connection with:

  • The User’s violation of this Policy
  • Unauthorized use of the Portal
  • Any breach of applicable law or intellectual property rights

Severability

If any provision of this Policy is found to be unlawful, void, or unenforceable under applicable law, the remaining provisions shall remain in full force and effect.

Changes to This Policy

CybHop Tech LLP reserves the right to update or modify this Privacy Policy at any time without prior notice. Users are advised to review the policy periodically.
